Acceptance of terms and conditions (the “terms and conditions”)

Please read these terms and conditions carefully. These terms and conditions, together with our privacy policy, and any additional terms, conditions, notices and disclaimers displayed elsewhere on this website, www.yallawheels.com, (the “Website”) or on our mobile application (the “App”) govern your access to and use of our various products, services, apps, and software (collectively, our “Services”). By continuing to use and/or view this website and/or any of the services, you agree to be bound by these terms and conditions.

Definitions

• Service: The E-Bike and E-Scooter sharing service provided by Yalla Bikes website, app, and/or software.
• User: Any individual who registers and uses the Service.
• E-Bike: An electric bicycle provided by the Service.
• E-Scooter: An electric scooter provided by the Service.
• App: The mobile application through which users access the Service.
• Docking Station: Designated areas where E-Bikes and E-Scooters are stationed for pick-up and drop-off.

Eligibility

To use our services, you must be at least 18 years old and possess a valid driver’s license. These requirements ensure that riders have the necessary maturity and have undergone proper training to operate the vehicles safely. Compliance with these eligibility criteria is mandatory.

Intellectual property

This website contains information and material (the “material”) that is protected by intellectual property rights, including but not limited to, trademarks, copyright and database rights, in the content and materials included throughout this website, including but not limited to, graphics, illustrations, text, images, software, digital downloads and audio and video clips and a combination of them or of other materials and are the sole property of Arada Developments LLC and/or its affiliates and are protected by applicable trademark, copyright, database and other laws and all such rights are reserved by Arada Developments LLC and/or its affiliates.

Account Registration

To be able to use our services you must first register and create a user account in the Yalla App. You may register one time only. During the registration you will be asked to accept these terms and to provide your name, personal mobile number, email address, and valid payment details.  Accurate and up-to-date information is required. Once the registration process on the app is completed you will be responsible for maintaining the confidentiality of your account credentials and any activities under your account.

Using the Service

We urge you to use our services responsibly, follow all local traffic laws and safety guidelines., and to use them for personal transportation only not for commercial purposes.
We recommend that you inspect the vehicle before using it and report any damages or issues via the App or the Whatsapp number. You will be responsible for the vehicle from the time you unlock it until you properly return it to a docking station.

Fees and Payments

Our Service operates on a pay-per-use basis and all applicable fees must be paid through the App using your linked payment method. If the vehicle is not returned within the designated time, late fees may apply.
You also must be aware of the following payment conditions:
The first 10 minutes of service usage is mandatory and non-refundable, meaning that once a ride is initiated, the initial 10 minutes cannot be refunded under any circumstances. Additionally, to ensure uninterrupted access to our services, users must have a minimum balance of AED 10/- in their account wallet. This balance is required to cover the unlocking fees and the first 10 minutes of the service . Refunds for remaining balance amounts will be processed upon request, except for the initial non-refundable 10-minute charge.
We reserve the right to change the rates, fees, and charges at any time without prior notice. Any changes will be effective immediately upon being posted on our platform or communicated to users by another means. It is the user’s responsibility to regularly review our rates and charges. Continued use of our services following any changes constitutes acceptance of those changes.
We take security of your payment method seriously. However, in the event of a breach of security involving your payment method, you agree to immediately notify us and take all necessary steps to mitigate any unauthorized use of your method. We are not liable for any loss or damage arising from your failure to comply with this security obligation.

Vehicles Availability

Our services operate with a limited number of vehicles and the availability of these vehicles is not guaranteed at all times. Vehicles will be distributed across a defined service area, and their availability may vary based on demand and operational needs. We cannot ensure that a vehicle will always be available at your preferred location and/or time.

Safety Guidelines

We want you and the people around you to be safe. Hence, we urge you to follow safety guidelines. Besides riding responsibly, you must wear a helmet while using our products, do not carry passengers, animals, or loads that exceed the vehicle’s weight limit, do not use a mobile phone while riding, and most importantly you may not operate the vehicles under the influence of alcohol, drugs, or other substances.
For your safety and others, you are not allowed to use our products for off-road rides, racing, or in areas like, skate Parks, landscape areas, roads, and walking paths. So please use them in the designated areas and make sure you experience caution all the time. You acknowledge that you may be responsible for any injury, and/or damage caused to other people and property as a result of your use.
Please park the vehicles responsibly to avoid obstructing public pathways or violating local parking regulations, and do not leave them in areas which we cannot access.

Maintenance and Responsibility for Damages

We will handle the Routine maintenance. Though, we urge you to report any damages or malfunctions immediately through the App or Whatsapp number after use. You may be held financially responsible for any damages caused by your negligence or improper use of the vehicles.

Liability

The vehicles are provided “as is,” and Yalla Bikes does not guarantee their performance or safety. You are fully responsible for any injury, loss, or damage incurred while using the Service. You are also liable for all traffic violations, public order regulations, and damages occurred for not following the safety guidelines mentioned in section 8.
We do not accept any liability for any indirect or consequential damages resulting from the use of the Service. We reserve the right to identify you to the authorities or public administration in the event of violating traffic regulations while using our products.
This website/app may contain hyperlinks to websites operated by third parties. Such hyperlinks do not form part of the website and are out of our control. We are not responsible for the content of these websites, nor do we represent the privacy policy or practice of such third-party websites, and we are not responsible for their privacy policy. Inclusion of such hyperlinks on the website are provided for your convenience and do not constitute our endorsement of the content of such third-party websites, their products, services or advertisements. The content, accuracy, opinions expressed, and other links provided by these resources are not investigated, verified, monitored, or endorsed by us. We do not accept any responsibility for any communications or arrangements between you and the third party. We do not accept any liability in the event that you participate in any activities conducted by third parties that we may have promoted, advertised or sponsored including functions, events, offers or competitions.

Indemnity

As a user of this website and/or services, you agree to indemnify us from and against all liabilities, costs, expenses and damages that arise or may arise out of, or in relation to, (i) any claim resulting from your use of, or access to this website and/or services; or (ii) use of, or access to, this website and/or services whatsoever or howsoever, including breach of the terms and conditions.

Account Suspension and Termination

We may suspend or terminate your account for violations of these terms, repeatedly default in making payments for the service, use our products under the influence of Alcohol, or drugs, and/or modify, copy, distribute, reproduce, transfer or sell any information, material, software, products or services owned by Yalla Bikes.
You can terminate your account at any time by contacting customer support but please make sure that all outstanding fees must be paid upon account termination.

Privacy and Data Use

All information and material submitted to us via website/app grants us, and subject to the terms and conditions also to each user of the service, a non-exclusive, worldwide, perpetual, royalty free, license to use, reproduce, edit and exploit the information and material in any form and for any purpose and we shall be free to use, and to modify, store and disclose, for any purpose, any ideas, concepts, know-how or techniques contained in the information or material you or a user of this service provides us with. We shall not be subject to any obligations of confidentiality or privacy regarding submitted information except as agreed by us, as specifically set forth elsewhere on this website, in our privacy policy, or as otherwise specifically agreed or required by law. We accept no liability in relation to any such information or material submitted to us.
Your personal information will be collected and processed in line with our Privacy Policy. By using the Service, you consent to the collection and use of your data for operational purposes.

Changes to Terms

Yalla Bikes reserves the right to update or amend these terms and conditions to the extent necessary as required by law or technological changes. We will notify you by email. Continued use of the Service after changes are made constitutes your acceptance of the new terms.
These terms and conditions are subject to change and can be modified at any time without notice. Your continued, or subsequent, use of this website/service following the posting of changes to these terms and conditions further signifies that you accept such changes. If you do not agree with these terms and conditions, or object to any changes to the terms and conditions, please immediately discontinue using or viewing this website/app.

Severability

If any provision of these terms and conditions is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed from these terms and conditions and rendered ineffective as far as possible without modifying the remaining terms and conditions, and shall not in any way affect any other circumstances of or the validity or enforcement of the other terms and conditions.

We reserve the right to disclose your personally identifiable information including when we believe that disclosure is necessary to enforce or to apply our terms and conditions, protect

Governing Law

Governing law and jurisdiction by accessing the website and/or obtaining the facilities, products or services offered through this website, you agree that the terms and conditions and the accessing and the provision of the facilities, products and services, shall be governed by the laws of the emirate of Sharjah and the applicable federal laws of the United Arab Emirates (UAE). You further agree to submit to the exclusive jurisdiction of the courts of the emirate of Sharjah, UAE, in relation to any matter, dispute or conflict arising out of, from, or in relation to, these terms and conditions or this website.
